Conflict of Interest Policy

Conflict of Interest Policy It is the policy of this school that elected or appointed school governance body members, independent contractors/business vendors, school administrative officers, and school employees shall not place themselves in any position where their private, personal interests may conflict with their official duties, or where they may directly or indirectly receive personal financial gain through direct or indirect personal influence.

All such persons shall be neither personally nor financially interested in any contract made by them or by the school that employs them. For purposes of this policy,

1) 'personally interested' shall mean any situation where private, personal interests conflict with official duties and shall include non-economic interests such as familial relationships, and

2) 'financially interested in any contract' shall mean any contract with an individual, entity, or company in which any such person, any such person's spouse, parents, children, civil partner, or any other person with a close personal relationship to any such person has an ownership interest, an investment interest, or a familial interest, and encompasses any situation where any such person's official judgment may be influenced by personal consideration or expectation of financial gain or any compensation or consideration of any kind other than that officially provided to any such person by the school.

Freedom Of Speech Policy

Sky Mountain Charter School believes that free inquiry and exchange of ideas are essential parts of a democratic education. The School respects students' rights to express ideas and opinions, take stands on issues, and support causes, even when such speech is controversial or unpopular.

Students' freedom of expression shall be limited only as allowed by Education Code 48907, 48950, and other applicable state and federal laws.

Students are prohibited from making any expressions or distributing or posting any materials that are obscene, libelous, or slanderous. Students also are prohibited from making any expressions that so incites students as to create a clear and present danger of the commission of unlawful acts on school premises, the violation of school rules, or substantial disruption of the school's orderly operation. (Education Code 48907)

The use of "fighting words" or epithets is prohibited in those instances where the speech is abusive and insulting, rather than a communication of ideas, and the speech is used in an abusive manner in a situation that presents an actual danger that it will cause a breach of the peace.

School officials shall not engage in prior restraint of material prepared for official school publications except insofar as the content of the material violates the law. (Education Code 48907)

The School shall not discipline any high school student solely on the basis of speech or other communication that would be constitutionally protected when engaged in outside of school, but may impose discipline for harassment, threats, or intimidation unless constitutionally protected. (Education Code 48950)

A student shall be subject to discipline for off-campus expression, including expression on off-campus Internet web sites, when such expression poses a threat to the safety of other students, staff, or school property, or substantially disrupts the educational program. The School Director or designee shall document the impact the expression had or could be expected to have on the school program.


Independent Study Policy

Sky Mountain Charter School offers independent study to meet the educational needs of pupils enrolled in the charter school (“Charter School”).  Independent study is an alternative education designed to teach knowledge and skills of the core curriculum.  

Charter School will provide appropriate services, supports, technology, and resources to enable students to complete their independent study program successfully.  These independent study policies have been established by Charter School in alignment with Education Code § 51745 et seq., updated to meet the requirements of Assembly Bill 130 (2021), and adopted pursuant to Education Code (“EC”) § 51747 and 5 C.C.R. § 11701. The following policies are effective as of the start of Charter School’s 2021-22 school year:

  1. For each student in independent study, Charter School will assign a certificated employee (also referred to as Education Specialist) to coordinate, evaluate, and provide general supervision of the student’s independent study instruction.  
  1. Charter School will serve students through individually designed curricula, which may include, but are not limited to, non-classroom based learning programs, cooperative school programs and classes, apprenticeships, on-the-job training, community-based educational programs, group seminars, distance learning via current technology, and supplemental learning projects.
  1. For pupils in all grade levels offered by the Charter School, the maximum length of time that may elapse between the time an assignment is made the date by which the pupil must complete the assigned work shall be twenty (20) school days. 
  1. When any student fails to complete 50% of assigned work during a twenty (20) schoolday learning period or fails to make satisfactory educational progress (defined below in Section 5), the Charter School will conduct an evaluation to determine whether it is in the best interests of the student to remain in independent study, or whether the student should return to or otherwise be placed in a regular in-person school program.  A written record of the findings of any evaluation will be maintained in the student’s permanent record. This record will be maintained for a period of three years from the date of the evaluation and if the student transfers to another California public school, the record will be forwarded to that school.  
  1. For purposes of conducting the evaluation in Section 4, a student is deemed to be making satisfactory educational progress if the student is on track to enter the next grade level at the completion of the current school year and/or progressing toward their goals pursuant to their individualized education program (“IEP”).  The Executive Director of Academics or designee is responsible for making this determination based on all of the following indicators:
    • The student’s achievement and engagement in the independent study program, as indicated by the student’s performance on student-level measures of student achievement and student engagement set forth in EC § 52060(d)(4)-(5).
    • The completion of assignments, assessments, or other indicators that show the student is working on assignments.
      • i. This review may consider monthly reviews of work, portfolios, tests, observation, student demonstrations, student grades, grades, student demonstrations, etc.
    • Learning required concepts, as determined by the supervising teacher.
    • Progressing toward successful completion of the course of study or individual course, as determined by the supervising teacher.
  1. Charter School will provide content to students aligned to grade level standards that is provided at a level of quality and intellectual challenge substantially equivalent to in-person instruction.  For high school students, this includes access to all courses offered by the Charter School for graduation and approved by the University of California or the California State University as creditable under the A–G admissions criteria.  

  2. If a student does not generate attendance for more than three school days or 60 percent of the instructional days in a school week, or for students who are in violation of their independent study written agreement, Charter School shall:
    • Verify student’s current contact information;
    • Notify parents or guardians of lack of participation within one school day of the student’s absence or lack of participation (e.g., via email, message, text, telephone, letter, etc.)
    • Reach out to the student directly and/or parents or guardians, as well as health and social services as necessary, to determine student’s needs for reengagement; and
    • If the student has failed to complete 50% of assigned work during a 20 schoolday learning period or failed to make satisfactory educational progress as defined in Section 5 herein, Charter School will schedule a pupil-parent-educator conference (a meeting involving all individuals who signed the student’s written agreement) to review the student’s written agreement and reconsider the independent study program’s impact on the student’s achievement and well-being. 
  1. Based on each student’s grade level, their assigned teacher of record will schedule and offer opportunities for synchronous instruction and daily live interaction at least as frequently as set forth in subsections a-c below.  

“Live interaction” means interaction between the student and Charter School staff, and may include peers, to maintain school connectedness.  Examples of live interaction include check-ins, progress monitoring, provision of services, and instruction, and live interaction can be in-person or in the form of internet or telephonic communication.  

“Synchronous instruction” means classroom-style instruction, designated small-group instruction, or one-on-one instruction delivered in person or in the form of internet or telephonic communication by the student’s assigned teacher of record (Education Specialist), and involving live two-way communication.  

    1. For students in grades TK-3, inclusive, their assigned teacher of record will schedule and offer opportunities for daily synchronous instruction.

    2. For students in grades 4-8, inclusive, Charter School will schedule and offer opportunities for weekly synchronous instruction and daily live interaction.  

    3. For students in grades 9-12, inclusive, their assigned teacher of record will schedule and offer opportunities for weekly synchronous instruction.  

Charter School will document each student’s participation in live interaction and synchronous instruction pursuant to Section 51747 on each schoolday, as applicable, in whole or in part, for which independent study is provided. 

  1. A student’s parent or guardian may request their student return to in-person instruction from independent study by making a written request to the Executive Director of Academics or designee or their assigned teacher of record (Education Specialist).  If a family makes such a request, Charter School will offer to help the student transition to enrolling in the in-person program offered by their district of residence within five school days.   
  1. A current written independent study agreement for each independent study student will be maintained on file. Each written agreement will contain the following: 
    • The manner, time, frequency, and place for submitting a student’s assignments, for reporting the student’s academic progress, and for communicating with a student’s parent or guardian regarding a student’s academic progress.
    • The objectives and methods of study for the student’s work, and the methods used to evaluate that work. 
    • The specific resources, including materials and personnel, will be made available to the student.  These resources will include confirming or providing access to all students to the connectivity and devices adequate to participate in the educational program and complete assigned work. 
    • A statement of the policies adopted herein regarding the maximum length of time allowed between the assignment, the level of satisfactory educational progress, and the number of missed assignments allowed prior to an evaluation of whether or not the student should be allowed to continue in independent study. 
    • The duration of the independent study agreement, including beginning and ending dates for the student’s participation in independent study under the agreement.  No independent study agreement will be valid for any period longer than one school year.
    • A statement of the number of course credits or, for the elementary grades, other measures of academic accomplishment appropriate to the agreement, to be earned by the student upon completion.
    • A statement detailing the academic and other supports that will be provided to address the needs of students who are not performing at grade level, or need support in other areas, such as English learners, individuals with exceptional needs in order to be consistent with the student’s IEP or plan pursuant to Section 504 of the federal Rehabilitation Act of 1973 (29 U.S.C. Sec. 794), students in foster care or experiencing homelessness, and students requiring mental health supports.
    • The inclusion of a statement in each independent study agreement that independent study is an optional educational alternative in which no student may be required to participate. In the case of a student who is referred or assigned to any school, class or program pursuant to EC § 48915 or 48917, the agreement also will include the statement that instruction may be provided to the student through independent study only if the student is offered the alternative of classroom instruction.  
    • Charter School will comply with the written independent study agreement signature requirements set forth in EC § 51747(g)(9), including:
      1. For the 2021-22 School Year Only (Must Obtain Signatures Within 30 Days of First Day of Independent Study Instruction): Charter School will obtain a signed written agreement from the student, or the student’s parent or legal guardian if the student is less than 18 years of age, the certificated employee who has been designated as having responsibility for the general supervision of independent study, and all persons who have direct responsibility for providing assistance to the student no later than 30 days after the first day of instruction.  
      2. Beginning School Year 2022-23 (Must Obtain Signatures Before Independent Study Instruction): Each independent study agreement will be signed, prior to the commencement of independent study, by the student, the student’s parent, legal guardian, or care giver, if the student is less than 18 years of age, the certificated employee who has been designated as having responsibility for the general supervision of independent study, and all persons who have direct responsibility for providing assistance to the student. For purposes of this paragraph, “caregiver” means a person who has met the requirements of Part 1.5 (commencing with Section 6550) of the Family Code.

  2. Before signing a written agreement, if the parent or guardian of a student requests, the Charter School will conduct a phone, videoconference, or in-person pupil-parent-educator conference or other school meeting during which the student, parent or guardian, and, if requested by the student or parent, an education advocate, may ask questions about the educational options, including which curriculum offerings and nonacademic supports will be available to the student in independent study, before making the decision about enrollment or disenrollment in the various options for learning.  

  3. Charter School will comply with all applicable recordkeeping requirements for independent study. This includes maintaining written or computer-based evidence of student engagement that includes, but is not limited to, a grade book or summary document that, for each class, lists all assignments, assessments, and associated grades.  
  1. No student with exceptional needs, as defined in EC § 56026, may participate in independent study unless the student’s IEP specifically provides for that participation.  
    • Each student who qualifies for special education services shall be provided a free appropriate public education in the least restrictive environment as required by applicable law.
    • Parents will ensure students attend all services as assigned by the school and attend meetings (e.g., IEP team meetings) to support their student’s education.
    • If a student misses two scheduled services or 50% of scheduled services within a month without reasonable justification (e.g., illness or family emergency), the student will be considered truant.  If a student is truant, the Charter School may schedule an IEP meeting to review matters such as the student’s educational progress and whether the parent is potentially blocking access to FAPE.
  1. Charter School may only receive funding for the provision of independent study to students who are residents of San Bernandino County or who are residents of a county immediately adjacent to San Bernandino County.  
  1. The Charter School shall comply with all applicable laws regarding the delivery of independent study. (EC § 51745 et seq.; 5 C.C.R. § 11700 et seq.)

Suspension and Expulsion Policy

This Pupil Suspension and Expulsion Policy has been established to promote learning and protect the safety and wellbeing of all students in an IEM Charter School. Although many of the students of the school will work from home, this policy is written broadly to apply as needed to students at school-sponsored activities or at school facilities.

Students who are suspended are expected to continue to work on their school work at home. Any work completed during a period of suspension will be assessed and accepted by the Education Specialist at the next learning record meeting.

A student identified as an individual with disabilities or for whom the school has a basis of knowledge of a suspected disability pursuant to the Individuals with Disabilities Education Improvement Act of 2004 (“IDEIA”) or who is qualified for services under Section 504 of the Rehabilitation Act of 1973 (“Section 504”) is subject to the same grounds for suspension and expulsion and is accorded the same due process procedures applicable to regular education students except when federal and state law mandates additional or different procedures. The school’s Special Education Director shall be consulted in all cases of potential suspension or expulsion relating to Special Education students to ensure compliance with all applicable statutes.

Enumerated Offenses

Students may be suspended or expelled from an IEM Charter School for any act specified in Education Code 48900, non-compliance with the terms of the written student agreement, or any material violation of any of the conditions, standards or procedures set forth in the charter, the school handbook, the student agreement, or the school’s policies and procedures. Education Code 48915 lists the non-discretionary and discretionary offenses for suspension and expulsion that IEM Charter Schools will follow.

Suspension/Expulsion Procedures

Based on information regarding student behavior or performance as specified above, at an IEM Charter School will send a suspension or expulsion notice to the student’s parent(s) or guardian(s). The notice will include an explanation of the charges against the student and the student’s basic rights. For suspensions of fewer than ten (10) days, if the pupil denies the charges, the school will provide an explanation of the evidence that supports the charges and an opportunity for the pupil to present his or her side of the story.

For suspensions of ten (10) days or more, or an expulsion, the parent(s) or guardian(s) of a student may request a hearing where the parent and the student shall be given an opportunity to participate and present facts relevant to the issues set forth in the notice.

At the hearing, the student will be provided a fair opportunity to present testimony, evidence, and witnesses and confront and cross-examine adverse witnesses, and the student will have the right to bring legal counsel or an advocate. In the event of any such request, an assigned school administrator shall appoint a Hearing Committee composed of no more than five (5) members consisting of one ES, one Advisor, two (2) members of the Governing Board/Parent Council, and the Board/Council President or designee (a neutral officer), which shall conduct a hearing regarding the notice. After the hearing, the Hearing Committee shall send its decision to the assigned school administrator. An expelled student shall have no right to appeal and the Hearing Committees decision is final.

In the event of a student’s expulsion, IEM Charter Schools will notify the Superintendent of the school district of the student’s last known address within thirty (30) days, and shall, upon request, provide that school district with a copy of the cumulative record of the pupil. Expelled students who are subject to compulsory full-timed education pursuant to Education Code 48200 have a duty to attend the school district in which the parent or guardian resides.

No student shall be involuntarily removed by the school for any reason unless the parent or guardian of the student has been provided written notice of intent to remove the student no less than five (5) school days before the effective date of the action. The written notice shall inform him or her of the right to initiate the procedures specified above for suspension/expulsion before the effective date of the action. If the student’s parent, guardian, or educational rights holder initiates the procedures specified above, the student shall remain enrolled and shall not be removed until the school issues a final decision.

Additionally, in the event of a suspension or expulsion for a student with a disability, all requirements set forth by IDEA (Individuals with Disabilities Act) will be followed.

Bullying Policy

IEM Schools is committed to providing all students with a safe educational environment in which all members of the school community are treated with dignity and respect and are free from harassment, intimidation or bullying. Bullying and harassment of students by students, school employees, volunteers and visitors will not be tolerated at IEM Schools. The school will not tolerate bullying or any behavior that infringes on the safety or well-being of students, staff or any other persons within the school's jurisdiction whether directed at an individual or group. IEM Schools prohibits harassment, bullying, hazing, or any other victimization based on but not limited to any of the following actual or perceived traits or characteristics: age, color, creed, actual or perceived national origin, race, religion, marital status, sex, sexual orientation, gender identity, physical or mental ability or disability, ancestry, political party preference, political belief, socioeconomic status, immigration status, or familial status.

IEM Schools expects students and/or staff to immediately report incidents to an administrator. A staff member who witnesses such acts will take immediate steps to intervene when safe to do so. Each complaint of bullying or harassment shall be promptly investigated. This policy applies to students at the school office, learning center, testing sites, and during a school-sponsored activity. IEM Schools and its students, parent/guardians and community have an obligation to promote mutual respect and safe, harmonious relations that support dignity and equality. To that end, IEM Schools has in place policies, procedures, and practices that are designed to reduce and eliminate bullying and harassment as well as processes and procedures to address incidents of bullying and harassment when they occur. These policies and procedures must be disseminated annually to staff, students, and parents/guardians.

Parent-teachers should discuss this policy with their students in age-appropriate ways and assure them that they need not endure any form of bullying. Students who bully are in violation of this policy and are subject to disciplinary action up to and including expulsion.

The Student Code of Conduct includes, but is not limited to:

  • Any student who engages in bullying may be subject to disciplinary action up to and including expulsion.
  • Students are expected to immediately report incidents of bullying to an administrator.
  • Students can reply on staff to promptly investigate each complaint of bullying in a thorough and confidential manner.
  • If the complainant student or the parent of the student feels that appropriate resolution of the investigation or complaint has not been reached, the student or the parent of the student should contact the Director. The school system prohibits retaliatory behavior against any complainant or any participate in the complaint process.

The procedures for intervening in bullying behavior include, but are not limited, to the following:

  • All staff, students, and their parents will receive a summary of this policy prohibiting intimidation and bullying: at the beginning of the school year, as part of the Parent/Student Handbook and/or information packet, as part of new school orientation, and as part of the school system's notification to parents.
  • IEM Schools will make reasonable efforts to keep a report of bullying and the results of investigation confidential.
  • Staff who witness acts of bullying shall take immediate steps to intervene when safe to do so. People witnessing or experiencing bullying are strongly encouraged to report the incident; such reporting will not reflect on the target or witnesses in any way 

In addition to the grounds specified in Education Code sections 48900, sections 48900.2, 48900.3, and 48900.4 provide additional authority to discipline a student in any of grades 4 to 12, inclusive for conduct that amounts to bullying. (Education Code 48900, 48900.2, 48900.3 and 48900.4)

Reporting Violations of this Policy

An administrator IEM Schools shall be responsible for receiving complaints alleging violations of this policy. All staff are expected to provide appropriate supervision to enforce standards of conduct and, if they observe or become aware of bullying or harassing behavior, to immediately intervene, call for assistance, and report such incidents. The Parent Council requires that staff follow school procedures for reporting alleged acts of bullying and take all necessary action to protect the victim of bullying.

All other members of the school community, including students, parents/guardians, volunteers, and visitors, are encouraged to report, in writing, any act that may be a violation of this policy. Oral reports shall also be considered official reports. Reports may be made anonymously, but formal disciplinary action may not be based solely on an anonymous report. Prompt and reasonable investigation of alleged acts of bullying is expected. Students and staff are expected to report all incidents of bullying, teasing, or other verbal or physical abuse. Any students' who feel she/he is a victim of such behavior should immediately contact a teacher, counselor, administrator, or staff person. If the student who was bullied believes the situation has not been remedied, he/she may file a complaint in accordance with IEM Schools procedures. Students are to be informed annually of the process by which they may make a report of bullying or harassment.

Students who are victims of hate crimes have a right to report such crimes to the proper authorities.

Retaliation is Prohibited

Retaliation against a student because the student has filed a bullying complaint or assisted or participated in a bullying or harassment investigation or proceeding is also prohibited. Students who knowingly file false bullying or harassment complaints or give false statements in an investigation shall be subject to discipline by measures up to and including suspension and expulsion, as shall any student who is found to have retaliated against another in violation of this policy.


An allegation of bullying that involves sexual harassment, and the results of an investigation, shall be kept confidential to the extent reasonably possible. Immigration status of those involved in an incident shall also remain confidential except as required by law.

Explanation of Terms

Bullying is defined as any severe or pervasive physical or verbal act or conduct, including communications made in writing or by means of an electronic act, as defined, including but not limited to sexual harassment, hate violence or harassment, threats or intimidation, that has the effect or can reasonably be predicted to have the effect of placing a reasonable pupil, as defined, in fear of harm to that pupil's or those pupil's person or property, causing a reasonable pupil to experience a substantially detrimental effect on his or her physical or mental health, causing a reasonable pupil to experience substantial interference with his or her academic performance, or causing a reasonable pupil to experience substantial interference with his or her ability to participate in or benefit from the services, activities or privileges provided by a school.

Reasonable student means a pupil including, but not limited to, an exceptional needs student, who exercises average care, skill and judgment in conduct for a person of his or her age, or for a person of his or her age with his or her exceptional needs.

Examples of bullying may include but are not necessarily limited to the following:

Verbal: Hurtful name-calling, teasing, gossiping, making threats, making slurs or epithets, making rude noises, or spreading hurtful rumors.

Nonverbal: Posturing, making gang signs, leering, staring, stalking, destroying property, insulting or threatening notes, using graffiti or graphic images, or exhibiting inappropriate and/or threatening gestures or actions.

Physical: Hitting, punching, pushing, shoving, poking, kicking, tripping, strangling, hair pulling, fighting, beating, "pantsing", pinching, slapping, biting, spitting, or destroying property.

Emotional (Psychological): Rejecting, terrorizing, extorting, defaming, intimidating, humiliating, blackmailing, manipulating friendships, isolating, shunning, ostracizing, using peer pressure, or rating or ranking personal characteristics.

Cyber Bullying is defined as:

Electronic act means the transmission of a communication, including, but not limited to, a message, text, sound, or image, or a post on a social network Internet Website, by means of an electronic device, including, but not limited to, a telephone, wireless telephone or other wireless communication device, computer or pager.

The following is intended to provide guidance to assist staff and students in identifying bias-based behavior:

  1. Citizenship/Immigration Status: actual or perceived immigration status or status as a citizen of a country other than the United States of America.
  2. Disability: actual or perceived disability, or history of disability. The term "disability" applies to a person who (1) has a physical, emotional or mental impairment that substantially limits one or more major life activities, (2) has a record of such impairment, (3) is regarded as having such impairment. Major life activities include caring for one's self, walking, seeing, hearing, speaking, breathing, working, performing manual tasks, and learning. Some examples of impairments which may substantially limit major life activities, even with the help of medication or aids/devices, are: AIDS, alcoholism, blindness or visual impairment, cancer, deafness or hearing impairment, diabetes, drug addiction, heart disease, and mental illness.
  3. Ethnicity/National Origin: actual or perceived national origin or ethnic identity. National origin is distinct from race/color or religion/creed because people of several races and religions or their forbears may come from one nation. The term "national origin" includes members of all national groups and groups of persons of common ancestry, heritage or background; it also includes individuals who are married to or associated with a person or persons of a particular national origin.
  4. Gender: actual or perceived gender, pregnancy, or conditions related to pregnancy or childbirth. The prohibition against gender discrimination includes sexual harassment. Race/Color: actual or perceived race or color.
  5. Religion/Creed: actual or perceived religion or creed (set of fundamental beliefs, whether or not they constitute a religion)
  6. Sexual Orientation: actual or perceived sexual orientation. The term sexual orientation means heterosexuality, homosexuality, bisexuality or transgender identity.

IEM Civility Policy

It is the policy of IEM Schools that all school personnel, staff, students, and students' parents are required to be civil in all of their interpersonal school-related interactions. Civility does not require unqualified agreement or conformity of opinion. Under no circumstances will uncivil conduct at any school-related activity be tolerated.

For purposes of this policy, to be civil means to act with self discipline in a courteous, respectful and orderly way in every interpersonal communication and behavior. It also means that a person will treat other persons as he or she would like to be treated.

Uncivil conduct includes, but is not limited to: using an inappropriately loud voice; using profane, vulgar, or obscene words or gestures; belittling, jeering, or taunting; using personal epithets; using violent or aggressive gestures or body-language; repeatedly and inappropriately interrupting another speaker; repeatedly demanding personal attention at inappropriate times; purposefully and inappropriately invading personal space; purposefully ignoring appropriate communications; wrongfully interfering with another person's freedom of movement; wrongfully invading another person's private possessions; or, any other behavior that inappropriately disrupts school-related activities.

An expression of disagreement or a discussion of a controversial viewpoint is not uncivil if such expression or discussion is appropriately presented and does not disrupt a school-related activity.

Any school personnel who are uncivil shall be subject to disciplinary action.

Any student that is uncivil shall be subject to an administrative hearing and review for expulsion or dismissal.

In the event that any student's parent is uncivil during a school-related activity, school personnel to whom the uncivility is directed shall immediately warn the parent tocommunicate or act civilly. If the parent fails to correct the uncivil behavior as directed, the affected school personnel shall notify the parent that the school activity is terminated, and the affected school personnel shall refer the matter to school administrative personnel for further administrative or legal action, which may include, but may not be limited to, a prohibition from any further participation in school­related activities.

Social Media Policy

We understand that social media can be a fun and rewarding way to share your life and opinions with family, friends and coworkers around the world. However, use of social media also presents certain risks and carries with it certain responsibilities. To assist you in making responsible decisions about your use of social media, we have established these guidelines for appropriate use of social media.

In the rapidly expanding world of electronic communication, social media can mean many things. Social media includes all means of communicating or posting information or content of any sort on the Internet, including to your own or someone else's web log or blog, journal or diary, personal website, social networking or affinity web site, web bulletin board or a chat room, whether or not associated or affiliated with the Company as well as any other form of electronic communication. The same principles and guidelines found in Company policies and three basic beliefs apply to your activities online. Ultimately, you are solely responsible for what you post online. Before creating online content, consider some of the risks and rewards that are involved. Keep in mind that any of your conduct that adversely affects your job performance, the performance of fellow associates or otherwise adversely affects members, customers, suppliers, people who work on behalf of the Company or the Company's legitimate business interests may result in disciplinary action up to and including termination.

Do not discuss a situation involving named or pictured individuals on a social media site without their permission. As a guideline, do not post anything that you would not present in any public forum. Be Aware of Liability
You are responsible for what you post on your own site and on the sites of others. Individual bloggers have been held liable for commentary deemed to be copyright infringement, defamatory, proprietary, libelous, or obscene (as defined by the courts). You are also responsible for complying with the existing rules of social media web sites. Increasingly, employers are conducting Web searches on job candidates before extending offers. Be sure that what you post today will not come back to haunt you.
Know and follow the rules
Carefully read these guidelines along with the Company Standards of Conduct and AntiHarassment policies in this Employee Handbook, and ensure your postings are consistent with these policies. Inappropriate postings that may include discriminatory remarks, harassment,
and threats of violence or similar inappropriate or unlawful conduct will not be tolerated and may subject you to disciplinary action up to and including termination.
Be respectful
Always be fair and courteous to fellow associates, customers, members, suppliers or people who work on behalf of the Company. Also, keep in mind that you are more likely to resolve workrelated complaints by speaking directly with your coworkers other than by posting
complaints to a social media outlet. Nevertheless, avoid using statements, photographs, video or audio that reasonably could be viewed as malicious, obscene, threatening or intimidating, that disparage students or their families, associates or suppliers, or that might constitute harassment or bullying. Examples of such conduct might include offensive posts meant to intentionally harm someone's reputation or posts that could contribute to a hostile work environment on the basis of race, sex, disability, religion or any other status protected by law or company policy.
Be honest and accurate
Make sure you are always honest and accurate when posting information or news, and if you make a mistake, correct it quickly. Be open about any previous posts you have altered. Remember that the Internet archives almost everything; therefore, even deleted postings can be searched. Never post any information or rumors that you know to be false about the Company, fellow associates, students or their families, suppliers, people working on behalf of the Company or competitors.
Post only appropriate and respectful content
  • Maintain the confidentiality of Company trade secrets and private or confidential information. Trades secrets may include information regarding the development of systems, processes, products, know how and technology. Do not post internal reports, policies, procedures or other internal businessrelated confidential communications.
  • Do not create a link from your blog, website or other social networking site to a Company website without identifying yourself as a Company associate.
  • Express only your personal opinions. Never represent yourself as a spokesperson for the Company. If the Company is a subject of the content you are creating, be clear and open about the fact that you are an associate and make it clear that your views do not represent those of the Company, fellow associates, members, customers, suppliers or people working on behalf of the Company. If you do publish a blog or post online related to the work you do or subjects associated with the Company, make it clear that you are not speaking on behalf of the Company. It is best to include a disclaimer such as "The postings on this site are my own and do not necessarily reflect the views of the Company."
Using social media at work
Refrain from using social media while on work time or on equipment we provide, unless it is workrelated as authorized by your manager or consistent with the Company Equipment Policy. Do not use Company email addresses to register on social networks, blogs or other online tools utilized for personal use.
Retaliation is prohibited
The Company prohibits taking negative action against any associate for reporting a possible deviation from this policy or for cooperating in an investigation. Any associate who retaliates against another associate for reporting a possible deviation from this policy or for cooperating in an investigation will be subject to disciplinary action, up to and including termination.
Media contacts
Associates should not speak to the media on the Company's behalf without contacting the Director of Human Resources. All media inquiries should be directed to the (School Director / Director of Human Resources).
